In Australia, a de facto relationship is when two people live together as a couple on a “genuine domestic basis”, but are not legally married. The breakdown of such a relationship is known as a de facto separation.

Under Australian law, de facto couples have the same rights as married couples when it comes to resolving financial and parenting matters after a separation.

A court will determine if a de facto relationship existed by considering factors such as the relationship’s duration, shared finances, and public reputation. In most cases, a couple must have lived together for at least two years or have a child together to be eligible to apply for property or financial orders.

It’s important to note that there is a two-year time limit from the date of separation to initiate court proceedings for property and maintenance issues.
